Terms of Sale:

• "Cash or Check" payment must be made at time of delivery or pick-up unless credit has been established.
• "Overdue Accounts" are subject to a 1.5% per month service charge (18% per annum). We reserve the right to cancel credit at any time.
• "All Stock" listed is subject to prior sale, quantity limitations, incorrect count, crop limitations and damage or loss due to weather.
• "Seller Assumes No Liability" for delays in shipment or delivery resulting from causes beyond Seller's control.
• "Shipping Charges" will be due when the delivery is made or within 7 days.

Orders:

• "A Deposit" in the amount of 25% of the total purchase price is required on plants to be reserved for pick-up or delivery at a later date.
• "Customer Pick-Up" orders will be held for 10 days then returned to general stock.

Confirmations:

• "Are Subject to Availability" at time of shipment; however, every effort will be made to fill each order. Spring orders should be shipped/pick-up as early as possible, while they are still dormant.

Claims:

• We have no control over weather conditions anytime, or amount of care given material once it leaves out nursery. Out materials is dug to AAN standards. We give no warranty expressed or implied as to livability of nursery material. We exercise the greatest of care to keep all varieties true to name, but we will not be responsible to purchaser beyond amount of invoice. All claims must be made within 5 days after receipt of goods.
• "No Claim" will be considered on an overdue account.
